When to Use this Procedure
A parent may use this procedure for custody, visitation or child support if any of the following are true:
- Petitioner is married to the respondent, and no action is pending in any court for dissolution, legal separation, or nullity.
- Petitioner and respondent have signed a Voluntary Declaration of Paternity regarding the minor children, and no action regarding the children has been filed in any other court.
- Petitioner and respondent are not married and have legally adopted a child together.
- Petitioner and respondent have been determined to be the parents in juvenile or governmental child support case.
Petitioner
1. The following forms should be completed:
FL-210 Summons
FL-105 Declaration Under Uniform Child Custody Jurisdiction and Enforcement Act
FL-150 Income and Expense Declaration
FL-260 Petition for Custody and Support of Minor Children
The following forms may be attached to the FL-260 Petition:
FL-311 Child Custody and Visitation Attachment
FL-312 Request for Child Abduction Prevention Orders
FL-341(C) Children's Holiday Schedule Attachment
FL-341(D) Additional Provisions - Physical Custody Attachment
FL-341(E) Joint Legal Custody Attachment
2. Make two copies of the completed forms above. Any Fee Waiver form (see Quick Links at top of page)needs only one copy.
3. Take the original and both sets of copies to Room 113 in the Civic Center to file them. One copy set is for Petitioner's file. Only the Petitioner gets a copy of any fee waiver form.
4. The second copy set is to be served by a 3rd party (over 18 and not a party to the action) on Respondent with the additional forms:
Blank FL-105 Declaration Under Uniform Child Custody Jurisdiction and Enforcement Act
Blank FL-150 Income and Expense Declaration
Blank FL-270 Response to Petition for Custody and Support of Minor Children
5. The 3rd party completes the FL-115 Proof of Service of Summons.
6. Petitioner files the Proof of Service of Summons in Room 113.
