Elder or Dependent Adult Abuse Restraining Order

An elder or dependent abuse restraining order applies to a person seeking a protective order who falls within the definition of an elder or dependent adult as follows:

An elder is defined as a person who is 65 years or older.

A dependent adult is defined as a person who is between the age of 18 to 64 years and who has mental or physical limitation that restricts his/her ability to carry out normal activities.

Filing Requirements

If your application is granted, a hearing date will be set for the parties to appear in court. It is the responsibility of the petitioner to have the respondent personally served (by someone over the age of 18 and not a party to the action). In addition, the petitioner will be required to submit a copy of the filed paperwork to the appropriate law enforcement agencies. Proof of service on the respondent must be presented and filed with the court prior to the hearing.
